User Guidelines

The following user guidelines apply to any use of any services provided by The Show Site, Inc through, but not limited to, our website at http://theshowsite.com, hereby referred to as our “service platform”. Throughout these guidelines, we refer to exhibitors, businesses, private individuals or any other entities who are publishing requests for services provided, as “clients”; we also refer to trade show and event businesses, vendors, freelancing service providers, private individuals or any other entity seeking to provide quotes and services to clients as “vendors”; We also refer to any section of our service portal, that requires user credentials and is intended to not be available to the general public, as “member area”.

1. Definition of clients and vendors

1.1 A client describes a private or business entity who:

  • Is using our service platform with or without a user account.
  • Is intending to use our service platform to request quotes or service proposals from vendors.
  • Has accepted a quote or proposed service from a vendor through our service platform.
  • Has had a previous business relationship with a vendor, that he is able to document.

The definition of “client” contains, but is not limited to the above examples. Any interaction of clients, falling under the above examples, are hereby referred to as “service experience”.

1.2 A vendor describes a private or business entity who:

  • Is using our service platform with or without a user account.
  • Is intending to use our service platform to display or provide his services.
  • Is intending to use our service platform to provide quotes or propose services to clients.
  • Has provided a “winning” quote or service proposal through our service platform.
  • Has had a previous business relationship with a client, that he is able to document.

The definition of “vendor” contains, but is not limited to the above examples. Any interaction of vendors, falling under the above examples, are hereby referred to as “service experience”.

2. Use of our service platform by clients

2.1 Our service platform is openly available to all clients. (i) Tools and services, that we provide freely without requiring a user account, can be used at each individual clients discretion. (ii) Any tools and services, provided through our member area, can be used at each individual clients discretion, provided this user creates and logs in with a dedicated user account. Any use of services, provided through our member area, is not permitted without a user account.

2.2 Clients are invited to use our service platform at their own discretion. Our service platform is intended as a starting point to quickly gather information about events, venues, clients, vendors and other event related information. However, due to the nature of the event industry, information can quickly change and information shown in our service platform can become outdated. For this reason, we highly recommend verifying crucial information and not rely on our service platform as a single source of information.

2.3 Clients, who are seeking services or products in general or to attend future events, may post information about their desired product or service in a service request on our service portal, or might browse through our database of available vendors and contact vendors of their choice directly. (i) By posting a service request, clients agree to receive quotes and/or proposals from vendors, through our service platform. Clients may also be contacted by vendors through our service platform, in case vendors need additional information for a correct quote or proposal. (ii) Clients may post their service requests using and revealing their user account, or clients may post their service requests anonymously. (iii) We encourage clients to provide as much information related to their desired service or product as possible, in order for vendors to provide a reliable quote or proposal.

2.4 Clients who are posting service requests, are not required to accept any of the received quotes or proposals. (i) Accepting a quote or service request, does not automatically create a legal or binding contract between a client and a vendor. (ii) An accepted quote or proposal by the user, is however meant as a sign of intent of entering a contractual agreement with the vendor, based on the information and facts outlined by the client in the service request and the received quote or proposal from the vendor. (iii) Since an accepted quote or proposal is not a legal and binding contract, clients are not obligated to enter into a contract with the vendor who provided the accepted quote or proposal. Because accepting a quote or proposal after posting a service request is considered initiating a business interaction and therefore counts as part of the service experience, vendors are allowed to rate and review such behavior accordingly. (iv) If we receive repeated reports of clients not entering into legally binding contracts after choosing a winning quote or proposal, we might deem such behavior abusive and misuse of our service platform, and reserve the right to terminate the clients user account. Likewise, we ask clients to let us know if a vendor provided them with a quote, but ended up not willing to enter into a contract, not upholding to the quote or proposing a final contract that differed greatly from the quote provided through our service platform.

2.5 Clients may review or rate their service experience with a vendor. However, clients may only review or rate personal service experiences. It is not permitted to review or rate about a third parties service experience. (i) clients are not permitted to rate or review a vendor that they have previously owned, that they currently own, that a immediate family member currently owns, or that they are an executive of, an employee of or that they otherwise are in a professional relationship with. (ii) The service experience that you are rating or reviewing, must have occurred within the last 24 months from the date on which you left a rating or review. In an ongoing business relationship, such as a timed contract, a membership or a subscription, you are free to rate or review this company at any point in time during your business relationship, but no later than 24 months after the business relationship ended. (iii) To rate or review a vendor, clients are required to register a user profile, using a valid and current email address under which we are able to contact you.

2.6 Reviews and ratings should rely to your service experience with a vendor. (i) You are encouraged to be as specific and as factual as possible about your communication with the vendor, the received products or services quality and functionality, your overall customer experience, and any other facts that you might find worth mentioning. Please include all relevant points about your service experience with this vendor. (ii) It is perfectly fine to be offered an incentive by the vendor, such as offering you a gift, reward, discount or any other advantage in exchange for a rating or review. We ask you, however, to include this information in your review.  

3. Use of our service platform by vendors

3.1 Our service platform is openly available to all vendors. (i) Tools and services, that we provide freely without requiring a user account, can be used at each individual vendors discretion. (ii) Any tools and services, provided through our member area, can be used at each individual vendors discretion, provided this vendor creates and logs in with a dedicated user account. Any use of services, provided through our member area, is not permitted without a user account.

3.2 Vendors are invited to use our service platform at their own discretion. Our service platform is intended as a starting point to quickly gather information about events, venues, clients, vendors and other event related information. However, due to the nature of the event industry, information can quickly change and information shown in our service platform can become outdated. For this reason, we highly recommend verifying crucial information and not rely on our service platform as a single source of information.

3.3 Vendors are encouraged to browse our project section, to search for and identify any service requests that match the vendors experience, expertise, similar projects or that vendors are in any other way or form interested in providing a quote or a proposal for. (i) Clients are posting service requests to receive quotes through our service platform only. It is not permitted for vendors to directly or indirectly contact clients to provide quotes or information related to their service request on our platform through emails, phone calls, fax or any other means outside of the contact channels provided by our service platform. (ii) We encourage vendors to use the contact channels provided through our service platform, to gather as much project related information as possible from the user, in order to provide an accurate quote or proposal. If you are unable to provide a quote or proposal for certain details of the service request, or if certain parts of the quote or proposal are subject to change, make sure you clearly communicate this to the client in your quote or proposal. Generally, you are required to provide your quote as detailed and as exact as possible.

3.4 Your quote or proposal being accepted by the client, does not automatically create a legal or binding contract between a client and a vendor. (i) A quote or proposal being accepted by the client, is however meant as a sign of intent of entering into a contractual agreement with the vendor, based on the information and the facts outlined by the client in the service request and the quote or proposal provided from the vendor. (ii) Since an accepted quote or proposal is not a legal and binding contract, vendors are not required to enter into a contract with the client who accepted the quote or proposal. However, because providing clients with a quote or proposal is considered initiating a business interaction and therefore part of the service experience, clients are allowed to rate or review such a behavior accordingly. (iii) If we receive repeated reports of vendors not entering into legally binding contracts after providing a winning quote or proposal, we might deem such behavior abusive and misuse of our service platform, and reserve the right to terminate the vendors user account. Likewise, we ask vendors to let us know if a client doesn’t uphold his service request after accepting their quote or proposal.

3.5 Vendors may review or rate their service experience with a client. However, vendors may only review or rate personal service experiences. It is not permitted to review or rate about a third parties service experience. (i) The service experience that you are rating or reviewing, must have occurred within the last 24 months from the date on which you left a rating or review. In an ongoing business relationship, such as a timed contract, a membership or a subscription, you are free to rate or review this client at any point in time during your business relationship, but no later than 24 months after the business relationship ended. (iii) To rate or review a client, vendors are required to register a user profile, using a valid and current email address under which we are able to contact you.

3.6 Vendors are allowed to invite their clients to rate and review them on our service platform. However, when doing so, vendors must observe the following rules. (i) Vendors are not permitted to selectively invite users to rate and review their experience, but must ensure that clients are invited equally and identically. If a vendor only invites a limited number of clients to rate or review their experience, he must ensure that user invitations are sent in an objectuive, unbiased manner. (ii) The invitation must be neutral, unbiased and independent of whether the user is expected to have had a positive or negative experience with the user. The invitation especially must not include any attempts to influence the user to leave a positive rating or review despite their actual service experience, it must not include any attempts to influence the user to leave a positive rating or review by threatening or promising to rate the client likewise, or otherwise artificially achieve an outcome desired by the vendor.

3.7 We may at any time, without notice and without prejudice, suspend or block the vendors access to their account if we believe or suspect that the vendor is involved in behavior that is inappropriate or is in violation of the user guidelines or applicable laws or regulations.

4. Contractual relationships between clients, vendors and The Show Site, Inc.

4.1 Clients using any of the services provided through our service platform, enter into a contractual relationship with The Show Site, Inc, based on our terms & conditions, our user guidelines and our price list, available at the time of using our services.

4.2 Vendors using any of the services provided through our service platform, enter into a contractual relationship with The Show Site, Inc, based on our terms & conditions, our user guidelines and our price list, available at the time of using our services.

4.3 Clients accepting quotes or proposals for service requests through our service portal, contacting vendors through our service portal, or otherwise interacting with vendors, do not automatically enter into a contractual relationship with a vendor. (i) The above stated actions are considered a mutual agreement and intent into entering a contractual agreement, based on the outlined facts in the clients service request and the vendors quote or proposal. (ii) The actual contractual relationship between client and vendor is governed by a contract, including terms and conditions, that both client and vendor agree on. (iii) TheShowSite.com is not a contractual partner in any business relationships between the client and the vendor, that result from both parties interacting on our service portal. (iv) The contractual relationship between The Show Site, Inc. and clients or vendors is strictly limited to the service portal itself and it’s use to initiate business contacts between clients and vendors.

4.4 If client and vendor agree on using project management and/or escrow services provided through our service portal, such as but not limited to services that include escrow payment services, defines milestones and regulates payments and actions when reaching those milestones, defines a complaint system and actions resulting from this complaint systems, or any other service that regulates interaction, responsibilities and payment between client and vendor, The Show Site, Inc will act as a neutral arbitrator between client and vendor. (i) In this case, all decisions regarding these project management/escrow/milestone/complaints/interactions are made by us in best conscience, based on all information we have available about the interaction in question. (ii) Both client and vendor agree that they will accept and are bound by any decisions made by us. (iii) If client and vendor disagree with any of these decisions, any resulting issues are left to be resolved directly between the involved parties, outside of our service portal.

5. General guidelines of rating and reviewing service experiences

5.1 Both clients and vendors have the option of replying to reviews on our service platform. All replies to reviews must be truthful and of best knowledge, must not have sexist, political, racially discriminating, offensive, deceptive, misleading, fraudulent, threatening, abusive, harassing, unlawful, defamatory, libelous, tortious, obscene, pornographic or profane character, and must not violate any applicable local, national or international laws or regulations, other peoples rights, including any intellectual property rights or privacy rights. Replies must also not reveal any personal information about another individual, including a persons name, address, phone number, email address, credit card information or any other information that coudld be used to track, contact or impersonate that individual.

5.2 If a vendor or client reports a rating or review for contravening our user guidelines, they must provide an explanation for doing so, also called a “public reporting reason”. If we receive notice or otherwise become aware that ratings, reviews or replies violate these user guidelines, we may delete them without notice.

5.3 Sometimes we need to verify your review. In this case, we may contact you and request documentation to proof your service experience that you have rated or reviewed. We do not share such documentation that you send us with any third parties, including the reviewed client or vendor.

5.4 We do not, under any circumstances, accept fabricated ratings and reviews that do not reflect a genuine service experience. The direct and indirect creation of fabricated ratings and reviews is considered a breach of our user guidelines, which can lead to suspension and termination of the associated user accounts.

5.5 Ratings and reviews are considered user-generated content, and the removal of reviews is an exclusive matter between clients, vendors and us. Our user guidelines regulate the removal of ratings and reviews. For the avoidance of doubt, we do not remove reviews, in cases when (i) a client and vendor disagree on the course of events, (ii) consider a rating or review “unfair” because, for instance, it is based on events outside of their immediate control or (iii) any other situations in which the rating or review itself seems to be valid, but we are unable to verify the validity of the reason for leaving this rating or review. In these cases, such issues are left to be resolved between the involved parties.

5.6 We do not permit misuse of our ratings and review system, which includes, but is not limited to (i) purposefully leaving negative ratings or reviews, even if they do not reflect an actual user experience, (ii) incorrectly reporting negative reviews in an attempt to have them removed, or (iii) any other behavior, which is meant to manipulate ratings and reviews or to achieve the removal of negative ratings and reviews.

6. General interaction between clients, vendors and The Show Site, Inc.

6.1 Clients and users may be able to use The Show Site, Inc logos, graphics and trademarks, such as user rating and category rankings, available in the member area, to display them on their website, social media accounts or other marketing materials. (i) Clients and Users must make sure that the displayed information is always accurate and reflect the actual standing on our service platform.

6.2 We reserve the right to block your user account if you are misusing our service portal or otherwise impair our services. This includes, but is not limited to writing fabricated reviews, spamming our service platform, display threatening or abusive behavior, or any other violation of our user guidelines. If we block your account, you will not be able to sign in to your member area. Your user profile still exists and will be publicly available, but you will be unable to use any of our member services. If your account is blocked and you think this happened on accident or you want to delete your profile, please contact us at support@theshowsite.com.

6.3 We reserve the right to delete user profiles if we believe they are in violation of our terms and conditions, user guidelines or applicable laws. Examples of when we may delete your user profile include, but are not limited to: You have not provided a valid email address, including if the provided email address has expired or is no longer accessible by you. Your user profile contains an offensive or inappropriate picture or username. Your user profile has been used to create fabricated reviews or otherwise misused our services. You have created multiple user profiles.

6.4 We do not tolerate any threats, abuse or blackmail by clients or vendors. These include making unjustified claims for damages, or threaten legal action in order to have specific reviews removed. We especially do not tolerate verbal or physical threads against any employees or representatives of The Show Site, Inc. Such behavior is considered a breach of our terms & conditions and user guidelines, and will result in immediate suspension of your user account and filing reports with the relevant authorities.

6.5 We are committed to provide our customers with a positive and fair experience. Therefore, we work hard to maintain the integrity of our ratings and review system, based on a culture of trust and transparency. We reserve the right to enforce these user guidelines and applicable laws or regulations.

6.6 We may, at any time and without notice, make changes to these Guidelines. We will notify you about such changes via our Website and through email. You agree that your continued use of the Website or our services after we have posted a new version of these Guidelines constitutes your acceptance of them.
